In Texas, a DUI or DWI conviction can affect your driving privileges. Motorcycle riders also think of themselves. Can you get a motorcycle license with a DUI in Texas?

In many cases, having a DUI or DWI in your past does not prevent you from getting a motorcycle license. However, if your driver's license is suspended, or if there are other restrictions on your license, it could complicate the process.

The state of Texas typically requires a motorcycle operator to get a Class M license, or add a motorcycle endorsement to their existing driver's license. If you have a license suspension due to a DWI, in most cases, you need to resolve the suspension or comply with other required programs before you can legally operate a motorcycle. Sparks Law Firm can also answer questions like does a boating dui affect your driver's license?

Here's what you should know if you have a DWI on your record and want to ride a motorcycle in Texas.

If You Get a DUI, Does it Mean You Can't Get a Motorcycle License?

If You Get a DUI, Does it Mean You Can't Get a Motorcycle License?

Per Texas DWI/DUI laws, having a DWI on your driving record does not mean you cannot get a motorcycle license. However, you may not be able to get one right now.

Some people believe that if their driver's license is suspended and they cannot drive their car or truck, that they can get a motorcycle license instead, and legally ride. That, however, isn't how things go.

If your driver's license is suspended, so are your driving privileges. That includes your privilege to operate a motorcycle. Once your driving privileges have been restored, you can then get a Class M or endorsement to legally ride a motorcycle.

What Are the Requirements for a Texas Motorcycle License?

All motorcycle operators in Texas must have a Class M driver's license or endorsement. Generally, applicant's must complete an approved motorcycle safety course and provide proof of completion when applying for their license through the Texas Department of Public Safety. Additional testing or other requirements might be required based on the applicant's age, existing driving record, and other circumstances.

Adults who already have a valid driver's license in Texas and complete a safety course may have certain requirements waived.

A drunk driving conviction, including DWI/DUI charge, doesn't stop you from applying, but you still must complete all of the necessary steps to get a license to operate a motorcycle.

What if Your Driver's License Is Currently Suspended?

A DWI can result in the suspension of your Texas driver's license. The length and the circumstances of the suspension depend on a number of factors, such as the outcome of the criminal case and if you refused or failed field sobriety tests following your arrest.

If you currently have a suspended license, your driving privileges are restricted. Again, this means that getting a motorcycle license to attempt to still operate a vehicle isn't possible.

If you operate a motorcycle while your driving privileges are suspended, you could expose yourself to other legal problems. In Texas, this is a separate offense, and a conviction often results in a much longer suspension.

Before operating any motor vehicle after a DWI, make sure you understand the current status of your license and any restrictions that apply.

Can You Ride a Motorcycle With an Occupational License?

Some drivers with suspended licenses may qualify for an occupational driver's license. This is a restricted license that can allow a person to drive for certain essential purposes while their regular driving privileges are suspended.

An occupational license may allow driving for purposes related to employment, education, or essential household duties. However, restrictions can apply to when, where, and why someone is permitted to drive.

Whether an occupational license allows you to operate a motorcycle depends on the terms of the court order and your individual licensing circumstances. You should never assume that permission to drive under an occupational license automatically allows unrestricted motorcycle operation.

Violating the restrictions of an occupational license can create additional legal problems.

What if You Already Have a Motorcycle License When You Get a DWI?

If you already have a Class M license or motorcycle classification when you're arrested for DWI, the fact that you were driving a car rather than a motorcycle does not necessarily protect your motorcycle privileges.

A DWI-related suspension applies to your driving privilege. You generally cannot switch to a motorcycle and continue driving simply because the DWI occurred in another type of vehicle.

This distinction is particularly important for people who rely on motorcycles as their primary transportation. Before getting back on the road, make sure any applicable suspension has ended or you have obtained appropriate authorization to drive.

What Happens When Your Suspension Ends?

The end of the suspension period does not always mean your driving privileges are automatically restored.

Depending on the circumstances, Texas DPS may require you to satisfy certain reinstatement requirements. These could include paying applicable reinstatement fees, providing proof of required insurance, completing an alcohol education program, or satisfying other conditions associated with the DWI.

Once your driving privileges are restored, you can pursue a motorcycle license if you otherwise meet Texas requirements.

Checking your driver's license eligibility status with DPS can help you determine whether any outstanding requirements remain before applying. For more information, this DUI lawyer in Fort Worth may be able to help.

Can an Ignition Interlock Requirement Affect Motorcycle Riding?

Ignition interlock devices are another potential complication following a DWI. In certain cases, a court may require a person to install an ignition interlock device as a condition of driving.

An ignition interlock device requires a driver to provide an alcohol-free breath sample before a vehicle will start. Because motorcycles present different practical issues for interlock installation and compliance, anyone subject to an interlock restriction should determine exactly what their court order and driver's license restrictions allow before operating a motorcycle.

Ignoring an interlock restriction simply because you are riding a motorcycle instead of driving a car can potentially result in violations and further legal consequences.

A DWI Can Affect More Than Your Current License

A DWI Can Affect More Than Your Current License

For motorcycle enthusiasts, losing driving privileges can be especially frustrating. However, attempting to work around a DWI suspension by applying for a different type of license or operating another vehicle can make the situation worse.

A DWI arrest can lead to both criminal proceedings and administrative driver's license consequences. Challenging those consequences early may provide more options for protecting your ability to drive.
