Updated: Feb 11, 2022

If you have a professional license, it is important to act fast and have an attorney with experience help you through your situation.  Sparks Law Firm has represented individuals with all types of licenses.  For example, doctors, nurses, attorneys, teachers, pilots, and real estate agents, to name a few.

These professions are your livelihood.  You have invested time and money to receive the required education and license issued by the State of Texas or the federal government.

The Action You Take Depends on the License

The Action You Take Depends on the License

Each license has a different set of rules when it comes to reporting and potential punishment.  Several licenses require an immediate action on your part – a few within 72 hours – so time is of the essence. If your license requires immediate action, knowing exactly what to report OR how to phrase it can make a difference.  This will be your first contact with the licensing authority that has the power to suspend or revoke your license.  Reporting or responding in the correct manner can help to keep your license active and keep you working.

You will have both the license issue and the formal charge going on at the same time.  It is important to know that anything you do or say in the court can be used by the licensing authority and vice versa. You need to be very careful with how you proceed.  Additionally, there is an opportunity to use this to your advantage.

The licensing authority will have a process in place that may require certain documents or responses to be filed and could even require a hearing regarding the violation. There are steps you can take to improve your position and even avoid a hearing.

Providing Court Records

Once your formal court case is completed, most licensing authorities will request the documentation from the court.  There are specific phrases in the court record that could help you to save your license or avoid a hearing on the status of your license.  Knowing what each licensing authority is looking for is extremely important.  For example, an attorney and a pilot are charged with DWI. The attorney will have to deal with the State Bar of Texas.  The pilot will have to deal with the FAA.  The State Bar of Texas and the FAA each have their own set of rules and are looking for different requirements in the court records.

Hiring an attorney who has experience representing individuals with professional licenses is extremely important.
